Terms of Use for Hopmarks.com

To ensure better relations and best business practices we require all users to abide the following rules of the site of hopmarks.com.  If you disagree with any portion of these rules and regulations you may not use this site or anything involving this site for any reason.

If there are any items not covered in this terms of use, that is or will be a concern, you must contact Hopmarks.com with such concerns before using this site.

You must agree to the terms in its entirety before using this site, if at any point you have questions, you must get written clarification as to what that term means before using the site.  If you are unsure if any of the terms apply to you, then you are required to contact us, find out, and agree to the response before continuing to use the site.  If we do not respond, or answer the question you cannot use the site.

Reliability

Hopmarks.com reserves the right in its sole discretion to revise these Terms of Use for its Web site at any time without notice.  By using this Web site, you are agreeing to be bound by the then current version of these Terms of Use.

Liability

In no way will Hopmarks.com be liable for any loss or damage to any material or situation; this includes negligence on the part of Hopmarks.com.  In no way will you be permitted to seek a total of more than $5 from Hopmarks for any misplaced or undelivered material.  If such instance occurs you are also no longer permitted to use the site.  Delivery rates may vary but with the intent to get the books to the customers promptly.

Once delivered to the shipping address provided, the books condition, loss, damage, or other misfortune is the renters responsibility.

Buybacks

All buybacks will require a slip that is to be included with the package or we cannot guarantee payment.  If any books are sent to Hopmarks.com without the proper books suggested on the slip provided by Hopmarks.comm, Hopmarks.com holds the right to return the books without payment, or in few cases not return the book.

Hopmarks.com is not responsible for loss or damage of books during shipment.

Prices suggested by hopmarks.com may be changed if there is any misrepresentation of the products quality, exclusion of materials (normally has a CD with the book), is the wrong edition, or edition type is incorrect (teachers edition) which is determined byhopmarks.com.

Only 3 books with the same ISBNs may be sold to Hopmarks.com, for any quantities over 3 Hopmark.com may adjust the offer for the additional books that is different than the quote given.

Offers given are valid only if the package is received by USPS within 5 days after the quote was given.

Returns & Delivery

Returns of items rented from Hopmarks.com must be properly labeled and shipped before the due date.  Hopmarks.com will send one envelope and label for all rentals to your shipping address up to 10 weeks before the due date.  For rented books that are shipped out past the due date or not received at all, Hopmarks.com holds the right to charge an additional fee up to two times the original list price and $10.00 for each item. 

If an item does meet such criteria of tardiness, a request for book ownership may be made through email.  Hopmarks.com will have full discretion if the book can be purchased by the renter.

Hopmark.com provides a free label to return the book through USPS.

All packages should be shipped in an appropriate manner to avoid any damage of the book while being shipped.  If the book is damaged from shipment, an additional fee may be charged.

For all books delivered by Hopmarks.com, packages are sent promptly, but if our attempts to provide a timely delivery are not met, you relinquish the right to hold hopmarks.com responsible for it being late no matter the cause.

Early Returns

If a buyer seeks to return a rental early for any reason, and request a refund, Hopmarks will give such requests serious consideration, but you agree not to hold Hopmarks accountable if we choose not to offer the refund.

Condition

If the condition of the book rented is abnormal or poor, no matter the cause, you are required to report it to Hopmarks.com promptly (within 2 weeks of receiving the book), to avoid additional charges for returns.

Warrantee

Although we try hard to provide great customer service we do not guarantee a replacement of books purchased or rented through hopmarks.com or offer any warrantee on them. 

Ownership

All items rented from Hopmarks.com may or may not initially be owned by Hopmarks.com but by a third party.  Once you receive the book it is owned by Hopmarks.com and will require its return to Hopmarks.com at its current location provided by the USPS label upon the due date.

Account Creation

You may only create one account and must be 18 or older.  You cannot use a name that is false or create an account for anyone that is under the age of 18 who does not understand the terms of use and agree to them.  Hopmarks holds the right to terminate your account for any reason.  Passwords are your responsibility to retain or remember.

Notification

You agree that the email you provide is the means that Hopmarks may reach you for reminders of book returns, but weather Hopmarks does or does not send a reminder, you will be required to adhere to the due date given when renting the book.

Credit Cards

Hopmarks may require a credit card to be tied to each account, which must be valid, please be aware that validation processes may take place to ensure the account is active, in which you will maintain such source of payment as reliable and secure, which is your responsibility.   We are not responsible for stolen accounts.

Third Party

Links to or from Hopmarks.com may be found on other sites, such sites are not the responsibility of hopmarks.com and you will not hold hopmarks.com responsible for anything on any site other than from hopmarks.com.

Privacy Policy

Hopmarks.com will not sell or distribute your personal information to any third party.  You agree to allow Hopmarks.com to use your personal information, which will primarily be used for the notification of due dates, and customer service replies.

Indemnity

You agree to hold all associates and employees with hopmarks.com and the company of hopmarks free of any claims against them, including any legal fees in any instance, no matter the situation.

Rights of Material

Any material submitted to Hopmarks, such as quotes, photos, videos, exc… may be used at Hopmarks discretion.  If you do not wish to have your information quoted you must be sure to make that statement clearly attached with the material you do not want quoted or used.

Infringement

You may not in any way use material, adds, letters, logos, exc… from Hopmarks.com or any of its adds in any way, such actions may likely result in heavy penalties including court costs, fees, and pay for losses incurred on Hopmarks.com.  All materials on this site are restricted from use.

Severability 
If any provision of these Terms of Use is found by a court of competent jurisdiction to be unlawful, void, or for any reason unenforceable, the remainder of these Terms of Use shall continue in full force and effect.
